Notice of Intention to Amend Bylaw 125-2018 Pursuant to the Ontario Heritage Act

The Ontario Heritage Act requires that notice to the public be provided if council intends to consider changes to a bylaw designating a building or property to be of cultural heritage value or interest.

Many attributes of the property known as 240 Garafraxa Street North in Durham have been set out in a bylaw designating that property to be of cultural heritage value or interest.  The owner of the property has requested consideration of minor amendments to the bylaw in order to proceed with updating single pane windows to energy efficient windows and to address safety issues with internal stairs in order to comply with the Building Code Act.

The following Notice shall be published in the Hanover Post on July 22, 2021.

Notice of Intention to Amend Bylaw 125-2018 Pursuant to the Ontario Heritage Act

Notice is hereby given that the Council of the Corporation of the Municipality of West Grey intends to amend bylaw 125-2021, pursuant to the Ontario Heritage Act, for the property known as 240 Garafraxa Street North, Geographic Town of Durham, in the Municipality of West Grey, in the Province of Ontario, legally described as PIN:37318-0527(LT):Part Lt 19 W/S Garafraxa Road Plan 500 Durham, Parts 4 & 5 ON 16R10764; Together with an easement as in GS54800; Subject to an easement over Pt 5 16R10764 as in GY141495; Municipality of West Grey; and PIN:37318-0528 (LT): Part Lt 19 W/S Garafraxa Road Plan 500 Durham, being Part 3 16R10764; Municipality of West Grey.

The property’s designation bylaw is being amended to allow the attribute of windows be amended to allow energy efficient windows while maintaining the character of the attribute; and to remove the interior staircase from the listed attributes to allow amendments necessary for safety and compliance with the Building Code Act.
