The Canadian Constitution assigns spheres of jurisdiction to the federal and provincial governments. Municipalities are under the jurisdiction of the province and only have the powers that are specifically given to them in provincial legislation, like the Municipal Act, 2001.

Section 2 of the Municipal Act, 2001 provides that municipalities are to be responsible and accountable governments with respect to matters within their jurisdiction and Section 11 outlines the spheres of jurisdiction for lower and upper tier municipalities.
